1. Agreement to Terms

By accessing and using NurseLearn ("the Service"), operated by West Valley Nurse Practitioners, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

NurseLearn is an educational platform designed to help nursing students prepare for certification exams at various levels (CNA, LPN, RN, NP). The Service provides:

• Educational lessons and curriculum content
• Practice questions and quizzes
• Flashcards and study tools
• AI-powered tutoring assistance
• Progress tracking and analytics
• Testing guides and exam preparation resources

To use the Service, you must:

• Be at least 18 years old or have parental consent
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Not share your account with others
• Notify us immediately of any unauthorized access

You are responsible for all activity under your account.

5. Subscription and Payment

5.1 Subscription Plans

We offer weekly, monthly, and yearly subscription plans. Prices are displayed on our pricing page and may vary by tier (CNA, LPN, RN, NP).

5.2 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You will be charged using your selected payment method.

5.3 Payment Processing

All payments are processed securely through Stripe. We do not store your complete payment information.

5.4 Failed Payments

If a payment fails, we will attempt to retry. If payment cannot be processed, your subscription may be suspended or cancelled.

6. Cancellation and Refunds

You may cancel your subscription at any time through your Account Settings. Please see our Refund Policy for details on refunds and access after cancellation.

7. Acceptable Use

You agree NOT to:

• Share, copy, or redistribute our content without permission
• Use automated tools to scrape or download content
• Reverse engineer or attempt to extract source code
• Create derivative works based on our content
• Use the Service for any illegal purpose
• Impersonate others or provide false information
• Interfere with the Service's operation or security
• Share your account credentials with others

8. Intellectual Property

All content, features, and functionality of NurseLearn (including but not limited to text, graphics, logos, images, videos, questions, explanations, software, and AI models) are owned by West Valley Nurse Practitioners, LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial educational purposes only.

9. Third-Party Content

Some educational content may be sourced from Open Educational Resources (OER) and other third-party providers. We make reasonable efforts to ensure accuracy but do not guarantee the completeness or currency of third-party content.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability to you shall not exceed the amount you paid us in the 12 months prior to the claim
• We are not responsible for exam failures, lost time, or opportunity costs
• We are not liable for damages resulting from content inaccuracies

12. Indemnification

You agree to indemnify and hold harmless West Valley Nurse Practitioners, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

13. Changes to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We may also change pricing with 30 days' notice to active subscribers.

14. Termination

We may terminate or suspend your account at any time for violations of these Terms. Upon termination:

• You lose access to all content and features
• Your data may be deleted (see Privacy Policy)
• No refunds will be provided for violations

15. Governing Law

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Maricopa County, Arizona.

16. Dispute Resolution

If you have a dispute, please contact us first at support@nurselearn.co. We'll work in good faith to resolve it. If we can't resolve it informally, you agree to binding arbitration in Arizona.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.
